The fair market value of the equipment shall be the
current value of the equipment specified in the most
recent edition of Orion Blue Book, by Orion Research
Corporation, Roger Rohrs Publisher, or a valuation as
determined by CyberPower at CyberPower’s
discretion.
CyberPower reserves the right to inspect the
damaged CyberPower Surge Suppressor, the
damaged equipment, and the site where the damage
occurred. All costs of shipping the CyberPower Surge
Suppressor and the damaged equipment to and from
CyberPower for inspection shall be borne solely by the
purchaser. CyberPower reserves the right to negotiate
the cost and facility at which any repairs will take place,
and CyberPower must be notified and approve of any

not approved by CyberPower voids the warranty. If
CyberPower determines, in its sole discretion, that it is
impractical to ship the damaged equipment to

discretion, an equipment repair facility to inspect and
estimate the cost to repair such equipment. The cost,
if any, of shipping the equipment to and from such a
repair facility and of such estimate shall be borne solely
by the purchaser. Damaged equipment must remain
available for inspection until the claim is finalized.
Whenever claims are settled, CyberPower reserves the
right to be subrogated under any existing insurance
policies the claimant may have.
Standard CyberPower surge protectors are
designed to eliminate disrupting and damaging effects
of momentary (less than 1ms) voltage spikes or
impulses from lightning or other power transients. If it
can be shown that a voltage spike lasting longer than
1ms has occurred, the Occurrence will be deemed
outside the rated capabilities of the surge suppressor
and the warranty is void.
The CyberPower Surge Suppressor in use during
the occurrence is not provided to CyberPower for
inspection upon CyberPower’s request at the sole
expense of the purchaser;
CyberPower determines that the CyberPower Surge
Suppressor has been improperly installed, altered in
any way, or tampered with;
CyberPower determines that the damage did not
result from the occurrence or that no occurrence in fact
took place.
CyberPower determines that repair or replacement
of the damaged equipment is covered under

sole discretion, that the Surge Suppressor did not
function properly because it had defects in assembly,
materials, or workmanship, causing it to operate
outside design specifications, and the Surge
